The Paris Appeals Court (Pole 5, Section 4, June 7, 2017, no. 14/23455) turned down a party’s claim made on the merit of the brutal termination of established commercial relations, taking it that the terminated party was repeatedly in payment default. Failure to pay constitutes a fault depriving the condition of brutality.
